Scotty Lee Van Hawk — National Champion AMA Pro Superbike racer, philanthropist, father of two, and proud member of the Eastern Band of Cherokee Indians (Tsalagi) with Potawatomi roots — exposed corruption in Kosciusko County, Indiana in 2019.

What started as local retaliation for publishing CorruptKosciusko.com (with video confessions from officers) escalated into a coordinated, multi-year campaign of destruction by county and state actors:

  • Multiple warrantless raids violating the 4th Amendment
  • Excessive force causing permanent deafness (SSA-certified disability)
  • Fabricated criminal charges with zero evidence
  • Theft of 7+ trust-owned properties through fraud and collusion
  • Separation from his children for years

This is not isolated misconduct. It is a statewide pattern of corruption targeting vulnerable citizens, Native land trusts, and those who dare to speak out.

The Facts of the Case

A timeline of retaliation that began with exposing local corruption and escalated to the highest levels of Indiana's justice system.

2019 — Scotty publishes CorruptKosciusko.com exposing police misconduct and thefts. Includes video confessions from officers admitting warrantless raid and property theft.
April 2, 2020 — Illegal warrantless raid on home (no warrant, door broken down). Officers later confessed on video. This was the first 4th Amendment violation.
March 29, 2021 — SWAT raid using concussion grenades on a hearing-impaired father. Result: Permanent deafness and lifelong disability certified by Social Security Administration. Second 4th Amendment violation + excessive force.
October 8–10, 2024 — Jury trial on fabricated stalking charges. Convicted on three Level 5 felonies for phone calls, texts, and emails that never existed. All 10+ years of phone backups prove zero contact.
November–December 2024 — Sentenced to 9 years in prison despite zero evidence. While imprisoned and incapacitated, properties continued to be stolen.
December 4–5, 2024 — Fraudulent transfers of Armstrong Rd properties (Musquabuck Potawatomi Reserve Trust land) to a man who had been dead since 2015.
March 19, 2026 — Petition to Transfer filed with the Indiana Supreme Court. Appeal highlights multiple constitutional violations.

While Scotty was either falsely imprisoned or recovering from permanent injuries caused by the county's own SWAT raid, his children's trust properties were systematically stolen through fraud and bank collusion.

Civil Rights Violations — Up to the Indiana Supreme Court

The appeal and Petition to Transfer document a clear pattern of constitutional violations that strike at the heart of American justice. This case is no longer just about one man — it is about whether Indiana's courts will uphold the Bill of Rights.

4th Amendment — Unreasonable Searches & Seizures

Two illegal raids:

  • April 2, 2020: Warrantless entry, door broken, property seized without probable cause or warrant.
  • March 29, 2021: SWAT raid with concussion grenades on a disabled citizen. Excessive force caused permanent deafness.

Result: Permanent disability + theft of personal property during raids.

6th Amendment — Right to Counsel & Fair Trial

Scotty was forced to proceed pro se without a valid waiver of counsel. Standby counsel was denied. The trial court failed to obtain a knowing, intelligent, and voluntary waiver as required by law.

Speedy Trial Violation: Case dragged through pre-trial hearings from March 2023 to September 2024 despite repeated demands for speedy trial.

14th Amendment — Due Process & Equal Protection

Properties stolen through fraudulent transfers while Scotty was incapacitated or imprisoned — no notice, no due process, no opportunity to be heard.

Conviction based on zero evidence of any contact or threat. All digital records (10+ years) prove the alleged communications never occurred.

Targeting of Native American land trust (Musquabuck Potawatomi Reserve) continues Indiana's long history of dispossessing Indigenous people.

1st Amendment — Retaliation for Protected Speech

The campaign of destruction began immediately after Scotty published CorruptKosciusko.com exposing police corruption. The timing, the confessions on video, and the escalation prove retaliation for exercising his right to speak and petition the government.

Current Status: Indiana Supreme Court Petition (March 19, 2026)

The Petition to Transfer raises these exact constitutional violations and asks the Indiana Supreme Court to review the case. Issues include:

  • Denial of Sixth Amendment right to counsel without valid waiver
  • Insufficient evidence for all convictions (no contact ever occurred)
  • Speedy trial violations
  • Prosecutorial and judicial misconduct enabling property theft and child separation

This is no longer a local matter. It is a test of whether Indiana's highest court will allow these violations to stand.

7+ Properties Stolen Through Statewide Fraud

While Scotty was incapacitated by permanent injuries (from the county's SWAT raid) or falsely imprisoned, Kosciusko County and colluding banks executed fraudulent transfers and sales of trust-owned properties — including sacred Potawatomi land.

415 Lakeshore Dr, Culver

10,000 sq ft commercial building — Fire + immediate bulldozing Oct 9, 2019. Sold using unrelated judgment against dissolved corporation despite legal owner being Foundation for Underprivileged Children Trust since 2014. Violated Supreme Court order.

614 College, Culver

Direct ownership change & sale by county while incapacitated. First Federal Savings Bank breached contract, failed to serve or provide right to remedy.

1544 W 400 N, Warsaw (corrected address)

Direct ownership change & sale by county while incapacitated. Same bank collusion by First Federal Savings Bank.

1057 E 350 N, Warsaw (Commercial)

Vehicles, racing motorcycles, trailer, and RV stolen. County changed ownership while incapacitated. Bank collusion.

2901 & 2906 E Armstrong Rd (Musquabuck Potawatomi Reserve Trust)

Sacred Native land. Fraudulently transferred Dec 4–5, 2024 to a man dead since Feb 1, 2015. Lake City Bank committed fraud and directly assisted the state.

3481 N Nancy Dr, Warsaw

Northwest Bank failed fiduciary duty (held minority mortgage). Sold via unlawful judgment on wrong owner. First Federal also used same fraudulent judgment.

Overall Pattern of Fraud

  • Wrong owner targeted: Judgments against dissolved "The 27 Group" used years after dissolution — legal owner was the Trust since 2014.
  • Bank collusion: First Federal Savings Bank of Huntington, Lake City Bank, and Northwest Bank breached contracts, failed fiduciary duties, and assisted fraudulent transfers.
  • Transfers to deceased: Armstrong Rd properties transferred to a dead man in 2024.
  • Exploitation of incapacity: All thefts occurred while Scotty was disabled or imprisoned by the same actors.
  • Retaliation: Accelerated after publication of CorruptKosciusko.com.
